Following the receipt of a reasoned complaint concerning the infringement of the procedures, the competition for the selection of the Customs Manager was cancelled. A new competition will be announced in the near future.
In the light of the complaint lodged by one of the candidates for the position of Director-General of the Customs Department and the facts set out therein, concerning the allegedly unlawful composition of the selection board in that competition, a decision was taken to annul the selection board in the competition for the position of Director-General of the Customs Department and its decisions. The legislation stipulates that a member of the board must be an immediate superior or a substitute official.
It should be noted that the Supreme Administrative Court of Lithuania has clarified that the competition for recruitment to the civil service is a single act, the procedure of which covers all stages of the procedure for organising the competition, so that a breach of at least one of the stages of the procedure for organising the competition gives rise to a legal basis for declaring the results of the competition invalid and starting it (the competition) again, but not repeating the stage of the competition procedure during which the irregularity was committed (see the ruling of the Supreme Administrative Court of Lithuania of 7 March 2011 in administrative case No A-662-885/2011).
A new competition for the position of Director-General of the Customs Department will be announced in the near future.
